These terms apply to decorating work carried out by Jackson Painting and Decorating Ltd ("we", "us"), registered in England and Wales, company number 17182846, registered address 63 Cranford Road, Petersfield, Hampshire GU32 3NB ("the Company") for the customer named on the quotation ("you"). Nothing in these terms affects your statutory rights as a consumer.
1. Quotations
Quotations are written, itemised and free of charge, and remain open for acceptance for 30 days. The quoted price is fixed for the work described in the quotation. If, once work starts, we uncover conditions that could not reasonably have been seen at the survey (for example hidden rot, failed plaster or damp), we will tell you before doing anything about them and agree any additional cost with you in writing first.
2. Acceptance and cancellation
Accepting a quotation (verbally, in writing or by paying a deposit) forms a contract on these terms. If you are a consumer and the contract was agreed away from our premises (for example at your home or by phone), you have a statutory 14-day cooling-off period under the Consumer Contracts Regulations 2013. If you ask us to start within that period and then cancel, you may be charged for work already done. Outside the cooling-off period, either party may cancel with reasonable notice; you will only be charged for work completed and materials already purchased for your job.
3. Payment
For larger projects we may ask for a deposit, which will be stated on the quotation. Payment of the balance is due on completion of the work, on invoice, unless otherwise agreed in writing. We accept bank transfer. Invoices unpaid after 14 days may incur statutory interest under the Late Payment of Commercial Debts (Interest) Act 1998 (for business customers) or at 4% above the Bank of England base rate (for consumers).
4. Materials and colours
Paint systems and materials are as named in the quotation. If you supply your own materials, we cannot guarantee their performance. Paint colours can appear different between screens, sample cards and painted walls; we recommend sample patches for significant colour decisions, and we are happy to apply them.
5. Access and preparation of the property
You agree to give us reasonable access to the property during working hours and to remove or protect fragile or valuable items before work starts. We sheet, mask and protect the working areas and clear up at the end of each day.
6. Our work and guarantee
We carry out all work with reasonable skill and care, as required by the Consumer Rights Act 2015. Workmanship is guaranteed for 12 months from completion: if a defect in our workmanship appears in that time, we will put it right at no cost to you. This guarantee does not cover damage caused by structural movement, damp, leaks, impact, or failure of materials you supplied.
7. Insurance and liability
We hold public liability insurance. We are responsible for damage we cause through negligence. We are not liable for pre-existing defects in the property, or for losses that were not reasonably foreseeable when the contract was made. Nothing in these terms limits our liability for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
8. Photographs
We sometimes photograph finished work for our portfolio, website and social media. Photographs never include people, house numbers or anything that identifies the property or its location beyond the town, and we are happy to skip your job entirely - just say.
9. Complaints and disputes
If something is not right, tell us and we will come back and look. We aim to resolve any issue directly and promptly. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
